Default Wrong Card Shipped

I'm pretty confident i just realized i shipped a Jamal Murray blue wave prizm rc /99 BGS 9.5 , (BGS # 0009684902) instead of the blue mosiac prizm rc version BGS 9.5 about a week ago. Although similar, quite a difference in price.

Unfortunately I think you are at the will of the buyer. I would contact them and see how they respond. There still are some good and honest people out there.

I also agree that you’re at the will of the buyer.

I personally wouldn’t post their eBay username either. First, you made the mistake. Second, and possibly more important, they might get harassed by people viewing this thread and decide not to work with you. Or they might see this thread themselves and be upset that you didn’t reach out to them first (and subsequently ignore your requests).

Did it already get delivered? If not, you may be able to reroute it back to yourself and then you can send the correct one.

Most people can be aholes. Hopefully he gets the mail on a good day or he's one of the very few who is honest.

2 options:

1) if card not delivered and was sent with tracking, could try to go to PO to intercept it.
2) if card delivered, check with buyer.

Nothing else you can do.

Well legally they can keep the card.

From the FTC website.

https://www.consumer.ftc.gov/article...ed-merchandise

Q. Am I obligated to return or pay for merchandise I never ordered?

A. No. If you receive merchandise that you didn’t order, you have a legal right to keep it as a free gift.

Since you sent the wrong card it would be technically what they did not order and they can consider it a gift and keep it.

Thanks for the help. It was delivered about 6 days ago, and didn’t hear from him, or any feedback. Reached out today, but no response yet.

Well, the last /99 blue sold for 200$ and I sold the mosaics for 30$... so 170$ish

I would contact, explain this piece of mail belongs to someone else who purchased it, and you need to get it back, and send out their right card asap. Maybe toss them a few bucks on top of paying for return shipping- Or offer to send him something he collects to help make it right. Atleast thats what id do. Best luck with situation

I was in this situation except I was the buyer. I purchased a $130 card, received a $500 card. Not going to lie, I thought about keeping it but that didn't last long as i didn't want to be that guy. I did ask for return shipping fees.

In your case, the difference in price is less so I'm thinking you got a 75% chance.

This does not include items that were delivered to you by accident. That law is just to prevent people from sending you unsolicited items and then trying to extort you (the postal equivalent of a gypsy shoving a trinket in your hand and then asking for money).

There are plenty of cases where people get items misdelivered to them, refuse to return them, and end up in jail:

That case was a little different. If I recall the actual story the item was addressed to a different person with his mailing address and he signed for it using the name of the person who it was addressed to, that is what hung him.

You are right the law is to prevent an old scam where people would be sent something they did not order then 30 days later or so they would be billed for it because they kept it.

Odds are nothing would happen criminally most would call it a civil matter and leave it at that. In most cases it would be up to the buyer.

If they decide to keep the wrong card and not return it considering it a "gift" that's when I decide to fill a box with dog turds and mail it to them as they can also keep that as a "gift".
