Continuing on the topic of the FBI looking into the players associations and partners, Panini included a fun note in their recent filing related to their antitrust case against Fanatics. Among other things, Panini and Fanatics are fighting over the production of the trading card contracts.

Not sure where the data comes from, but the number of MLB players collecting cards has allegedly increased from less than 10 to over 100, since Fanatics bought Topps.

Wasn't that order issued months ago? Or did the judge finally give a deadline to produce it?

It was actually filed in 8/2023 to produce it. They did but it was heavily redacted. Now it needs to be in the clear.

Paul Lesko on Twitter says this isn’t a loss for Fanatics but their lawyers are just doing a good job of delaying the inevitable / racking up lawyer fees.

Might have been brought up already but Leaf was awarded the license from the MLBPA to make Min or League cards.

I think they are trying to delay it all the way to when the license(s) change hands. Possession really is 9/10ths the law.

IMHO a court wouldn't do that because both parties would suffer irreparable harm. I think more likely - but still a longshot - would be an injunction against the expiration of Panini's deal. IOW both companies would be allowed to produce licensed goods.

Let the record show I consider the above to be an extreme longshot though.

What I don’t know if anyone has ever clarified is when can Fanatics truly start printing product (vs selling) and give versa for Panini. Not sure if the license start date is connected to buying or printing.

I don’t know the exact lead time but I assume it’s at least 3-6 months to print and package. Ignoring any design time which I am sure they can do regardless.

Man did you guys see that one of the cut autos Topps did for Dynasty was take a 1993 Nabisco Willie Stargell auto card, cut it, and slap it in a Dynasty frame? lol get out of here

So did Panini and Upper Deck. And they've been doing it for years. They've cut a zillion Perez-Steele postcards for cut autos.

It's obviously working. Both the Nabisco and Perez-Steele autos are selling for 5-10x more when one of these companies cuts it. Might as well do it if people are paying more.

Ginter
Archives
Stadium Club
Platinum Anniversary
Museum
Cosmic Chrome
Heritage High Number
RIP
Brooklyn

And now with Topps' basketball license becoming active, Fanatics has even more products to try to get out the door.

Seems like they've stretched themselves waaaaaaaaaaaaaaay too thin in terms of acquiring licenses to far more intellectual property than they have production capability for.
