Who came out of the dog pile with it? That’s who owns the ball.

As soon as the kid let go and put his hands in the air it was over.

It's not who catches it, it's who walks away with it.

Sometimes life kicks you in the balls.

I'm assuming it's the guy in the red Marlins jersey that is suing?

Whoever it is will have a pretty hard time winning, because none of the videos really show him ever having possession.

Yeah, the video shows the kid in red with one hand on the ball while the guy who ended up with it seems to have it wrapped up in both hands. I don't think he's going to be able to prove that he ever had sole possession of it.

This is generally not true, but in this case it is sort of true.

Smart of the kid (or his family) to file the lawsuit.

Little risk for a potentially big reward.

The "owners" of the ball might be willing to pay a settlement or offer partial equity to keep the auction going.

Sounds like he is taking a $0 win and turning it into a -$20,000 win.....

That is when he needs to throw everything away and dive into the pile. The ball will cover 1000x his losses.

you can tell my his immediate reaction in the video that he felt like it was taken from him but i don't see anything in the video to back up how he feels.

But that's assuming:

(1) he doesn't get paid out

(2) his lawyers didn't offer him a deal (what if he/his fam worked a deal where, if they won the case, the lawyers would take a percentage of the settlement/equity; if they lost the case, the lawyers get nothing)

Need to get an NFL ruling to determine "possession" of the ball.

Correct,

I think they are very safe assumptions based on the video evidence that does not (in my opinion) show him having possession.

In my experience lawyers are very unlikely to take a case of this nature without a retainer. For the most part they are not degenerate gamblers like us card hounds.

At the same time, I could see the "owners" willing to settle quick (or offer a small equity) to be done with the lawsuit so they can proceed with the auction hassle-free.

Sometimes, the truth doesn't matter, and delaying the auction (of unknown length) can result in potential $ lost (e.g., loss of momentum, sudden change of economy, etc). People are always willing to sacrifice a little gain to get rid of any inconveniences to get that big payout ASAP.

It's not your traditional case too. Most lawyers aren't dealing with $3+ million dollar baseball lawsuits.

The likely scenario is a lawyer said "I will file a suit for you. Pay me xx% from what I can get you." It doesnt cost much to file a suit.

There is the other 1/10th of the law that sometimes applies.
