INSTRUCTIONS FOR FILING AN EMERGENCY REPLEVIN CASE
The Replevin action is used for resolving civil disputes involving personal property valued up to$15,000.00
(excluding court costs, interest and/or attorney’s fees, if applicable). This process allows an individual to recover
their property from another person who refuses to return the property to the owner.
Before filing your complaint, you must know where the property is located. You should attempt to get the
full proper name and address of the party/parties you want to sue. You will need to know the proper legal name
for the business, as well as the proper owners and their addresses. If you wish to sue a corporation, you need to
identify the name and address of a corporate representative who is available to accept service of legal papers. This
information can be obtained from the Florida Secretary of State, Division of Corporations, Tallahassee, Florida
32301. The website for the secretary of state is www.sunbiz.org.
Once you are prepared to file your case, you should complete a Replevin complaint form, supported by
invoices or other evidence of legal right to possession of the property in question. You will need to provide one
(1) copy of each for the court, plus one (1) copy for each defendant. An “Affidavit in Support of Emergency
Replevin” must also be filled out at the time you file the complaint.
The urgent nature of the emergency replevin requires that a bond be filed. This is collected as “good faith”
money to ensure that the property in question can be repaired, if damaged; or replaced, if destroyed. Once the case
is disposed, the judge will inform the clerk as to how the funds will be disbursed. The bond can be in the form of
cash, or a surety bond from an insurance company. A Clerk’s fee on collecting the cash bond is calculated at 3%
of the first $500.00, plus 1 ½ % of the remaining balance. The cash bond needs to be tendered as cash, cashiers
check, or U. S. Postal money order.

They have asked for permission to confiscate all cards through their authority with DOJ. At minimum we will find out who Consigned the Dual Finalists MJ/Rodman to PWCC.
Enrico is filing litigation in Federal Court and naming parties involved with the MJ first. Prizm god ultimately touched all the other cards, at least the Rodman "The Worm" and the Russel /6. Getting a ruling on the MJ will make the card HairyTrojan @windycity_sportscards ... Gerald Fortier much easier to deal with.

Gerald @ windycity_sportscards knew about these stolen cards from the very beginning
and was considered a friend and someone to be trusted prior to this entire event. He did deals with Enrico and was one of the few people Enrico thought would look out for these cards if they showed up.
Somehow, just as Raphael @ Prizm_gawd forgot who he paid $60,000 cash to for 4 cards, Gerald forgot about these specific cards that were stolen many years before. Gerald posted Enrico's Bill Russell /6 and without reading into Gerald's comment clearly pointing to Prizm as the person he acquired the card from, there is some reference to putting something behind them with this deal. Was it the card or the deal? Then, throughout the entire conversation Gerald insisted he would never pay more than $800 to Enrico because that is what he valued the card at when it was stolen. He would not let Raphael negotiate a settlement for just one card either which I found very odd. I have included some of the conversation Enrico and I had with Gerald for context. There are many messages, however, ultimately @windycity_sportscards and @prizm_gawd drew a line in the sand at $7000 and a signed release or nothing.

Gerald Fortier has always been known to be a super shady dude. Lots of threads about him here and on hobbykings. If his lips are moving, he’s lying. It amazes me that he and others like him are able to continue on in this hobby. Nothing ever happens to them. They must be laughing their heads off. Not so funny for their victims though.

And there is no way his ban was a mistake. He was running scams here. And hairyangryfella is one of BO’s top members, so it’s just another Gerald lie.

Lol, wow. I saw this had been bumped so decided to have a look in the hopes there had been some kind of resolve, only to see my name being dragged into things.

Firstly, Gerald has ALWAYS been a sleaze. But because he dealt in high end he was always seen as some kind of legend. People forget that some of the scummiest/most dodgy people are those who deal in high end. I certainly don't.
Secondly, I've only ever been in trouble on here for language/fighting with a-holes (like Gio or others who were banned and somehow reinstated), and while I've been suspended for that and warned to 'cut it out', I don't believe I've ever been 'meant to be banned'...

What an absolute cop-out from a bottom of the barrell turd who sadly shares a similar username.

Not surprised PWCC is once the outlet being used to sell this card but it's great to see the final missing card (Kobe) popup again, in the same BGS case that was reported stolen.

Really hope Enrico can get these items back. Would also be nice to trace these cards back and find out who had been holding on to them, hoping this thread would be forgotten,

Having lost my own package valued around $10k-$20k, I'm impressed people have the self control to rely on the authorities to resolve these issues once they have a target in sight. Not saying I would show up on someone's doorstep over $10k, but OP seems to have quite a bit more value than that, missing. Super frustrating.

I couldn’t imagine the frustration at that level either. Single cards worth the entirety of my collection? I’d probably need counseling.
