I purchased a 2019 Ford F-150 late November 2020. It was used with 17k miles.
The dealer gave me a auto check (like car fax) that showed the truck had no accidents. It did have a dent on the bumper but they said would fix it. I chalked it up to someone backed into a pole of something. Fast forward to yesterday. I go in for service and of course they are hitting me up wanting to buy my truck. I decide what the hell, I’ll see what they’d offer me. I put all my info in and my VIN number. The offer comes back saying my truck has a accident on record. Do I have a legit gripe or case against them for not disclosing this to me? Or am I screwed? Thanks for any help! I’m not after a paycheck. I just know my truck isn’t worth nearly what it would be worth with a accident on record. |

Depend on the state. Unfortunately a quick google search doesn't turn up any dealer obligations in Georgia to disclose accidents for used cars.

Depends on if it was a private sale. My Brother in law went to sell a car he had purchased from carmax, and found out it had "extensive" damage. I had a truck I wrecked twice that never showed up on carfax. I dont trust them. Anyway, he was offered a substantial amount less than what it would be worth, he raised hell with carmax and they ended up buying it back for what he paid.

I was going to say it all depends on who provided the info/documentation prior to you buying it. Each company is different on how they back things. Carfax from what I know has been pretty good with it, but its not perfect and subject to what data they can get/mine. So thats the first thing is finding out exactly who/what provided you with what info (and how you can document what you had at time of buying).

I purchased it from a local dealer. The biggest ford dealer in my town. Not sure if that matters.

did they repair the damage when you bought it? thats probably why its showing up now and not before it had been repaired.

Since it was from an official Ford dealership, you should be good. If you pressure management and they don't budge on a resolution, take it to directly to Corporate. I'm 99 percent sure they'll make it right by either buying it back for your purchase price or offering an adjustment.

Is the accident now showing on Autocheck or did they pull a CarFax?
If on CarFax is it listed as an actual accident or damage? Also is it listed as Minor, Moderate or Severe? Most of the time dealers will use the accident as an excuse to give someone less but in reality if it’s not major (with airbag deployment or frame damage) or moderate you will be able to get close to what it’s worth. If the dealership uses autocheck and you signed off on it when you bought it, then that’s that. They didn’t falsely represent the vehicle as not having and accident or damage as the autocheck showed no issues at the time of sale. From my experience Carfax is no good, if the owner of the wrecked vehicle pays for the damage without going through insurance. My brother had a $1K damage that his friend paid him for hitting him, Carfax never picked up the hit. This is why if you buying a dream car, it is better to inspect it before buying it no matter what the Carfax says.
