Okay, OP here again. I originally didn't want to post images and everything b/c I didn't want to derail the conversation into folk's opinion on whether it's the right card or not. I know it's not the right card so I was hoping to keep the conversation focused on just the review side of things. But sweet jesus has that ship sailed.

To me seller accepted return with no issues so for me its a no feedback situation. Honestly you sound like your mind is already made up so just leave it already. Just remember negs you leave can hurt you as well. When you make offers on items many sellers will look at your feedback left. Its more importnat for a buyer than the feedback they have received. As Ebay says about feedback its the BUYERS opinion so if you feel its justifed then do it. If Ebay has reason to believe you are not being honest or the seller did everything in his power to make it right then they will remove it.

Honestly, I don't know how many ways I can say it, I just started this thread looking for some advice. I'm not trying to trick anybody, I'm not trying to crap on anyone. Just wanted some insight from people who have been in this situation before since it's new for me.

To see how the seller described it and all No need to hide it if that is the actual photo the seller used it will be found eventually. Just takes some digging.

Based on these pics, the seller definitely sent you a different card. I agree.

In the beginning you should have just requested the correct card. If he would have refused, then it would have been clear that he sent the wrong one on purpose. That time has now come and gone, it would appear. Now he can simply say he would have if you were to have asked originally.

Thanks for the feedback. If I could do it over again I would have reached out and asked for the right card first. But when I opened it I was angry and felt that I had been purposely duped, so I just requested a return. I'll know better for next time.

It matters because it speaks to the sellers intentions and IMO that should factor into it. Not all situations are black and white easy answers.

Is it a massive seller who had multiples of this for sale took one picture and used it for all his listings and accepted the return easily because its a low value card? Is it a new seller who wasn't selling other cards etc.? Did he state the item you receive is not the item pictured etc.

This. There is no rule in itself against using stock photos at all in fact a lot of volume sellers do especially those who may have 5 or 6 copies of the same card. I don't put in my listings about it being a stock photo should be pretty obvious. I will however use the one in the group I feel is the lowest grade in the listing and use that for the photos. It has come back to me a time or 2 but its rare and everytime I just refunded upon return sorry I am not sending a replacement just not how most sellers who sell like this operate. If you are not happy you can return it or keep it. Simply stating return for refund or something similar goes a long ways with Ebay when it comes to getting negs removed.

The actual listing would settle it. As of now I am in the no feedback category because the seller took the return No questions asked or anything. I do it even when I know 100% I am right. Any issues a buyer may have my response is almost always the same three words. "return for refund."

In the end as I said earlier its ultimately the OPs decision but that decision could have repurcussions. Giving his soft positive for a seller using a card saver on a PWE that coupled with a neg might be enough to have sellers turn down offers he makes and possibly block him.

Shoulda seen the emails and negative I was left from a buyer over the weeked for a 29 cent overage on shipping. i charged 1.00 shipping it cost me 71 cents he blew a gasket and ended up getting himself removed from Ebay. The neg of course was removed.
