Neg Worthy?

Purchased this yesterday http://m.ebay.com/itm/302378422663 and today got a cancel/refund. Seller claims item is out of stock as it sold in store and they didn't update their inventory. Card was listed $4.76 obo of which I hit the BIN, I suspect they realize it was listed too low and don't want to send. Thoughts?
