I think he's implying that she had a fake ID and Giddey believed her. I don't know how that holds up in a court of law. Certainly it won't matter in the court of public opinion.

As far as criminal law is concerned, the state where the encounter took place is the state whose laws apply. If he crossed state lines with her, federal law applies (which is 18 years old).

Now the NBA can do whatever they want, and she may take him to civil court where different rules are in place.... and all this is to say nothing of the court of public opinion....

No, it doesn't hold up in a court of law. He is responsible for his actions and knowing her age.

I agree. Why not say something like "all I have to say is that the truth will come out." In the court of public opinion, that doesn't sound nearly as bad as "I understand the question - no comment."

If I'm innocent, can a lawyer explain how saying "the truth will come out" can be used against me in a court of law?

If I'm guilty or even did the slightest bit wrong here, saying nothing makes a ton of sense.

While the case/investigation is still pending, saying nothing makes the most sense whether you're innocent or guilty. You gain absolutely nothing by speaking out. That's what your lawyer is for.

Completely unexpected gossip at the gym regarding this -- one of the high schoolers working there says she's a classmate..showed us some photographic evidence.

Blonde chick goes to Laguna Beach High, the brunette Newport Harbor. Claim is they met at a bar/club.

Guess we will see what the NBA investigation turns up.

Yes. Regardless if this is a nothing burger or not, if my 17yr old posts that they just "f'd" ANYBODY I will smash their phone to pieces and lock them in their room to start....

We were already kind of trending that way, but tiktok and insta just put the proverbial nail in the coffin.

There are some creep posts from older men in this thread. Yikes.

I'm sure Giddey will get off in one way or another, probably some laundry bags being dropped off at her house.

Will the league do anything? I doubt it. They'll let the law handle the outcome.

Edit: an Australian Facebook card selling site has never seen so many J. Giddey listings. His old man Warrick can't be too happy.

No comment works for morons like Giddey who can’t be trusted to defend themselves without possible self-incrimination. He could certainly speak to the issue without causing himself problems. He’s just not intelligent enough to do it, so he gets no leash.

"Morons" may be a harsh word, but there is a natural tendency to answer a question when asked. If the accused has it drilled into his head "say no comment no matter what" then that is a very easy rule to follow.

Once you tell a client "well, if they ask you the question, you can say XYZ" then that just opens the can o' worms to follow up questions. It isn't like the media hears XYZ and goes away satisfied with the quote.

Exactly my point. Publicly traded companies speak on active or potential litigation all the time. Because the representatives can do so without it being a problem.

I used moron to describe Giddey, because that’s what he is. How else would you describe a star athlete stupid enough to engage in this type of behavior and voluntarily allow it to be posted on social media? Did he think it would stay private? Blessed with all this athletic talent and no brains. So disappointing.

Exactly. If she lied about her age (or it never came up because it was assumed she was 21 by being in the club) would mitigate the sentence, but he would still be convicted.
