This guy made some low-ball offers on a Prince Fielder gold relic I had, I straight declined and never heard another peep.

Ok, but some representative saying such doesn't really mean anything. You do not know what the other person gave them for information, be it bogus email's etc that were made using a PS program to guage the level of "back and forth". Words mean very little.

Like I said, I have no clue what the fine print says. I was an Ebay member pretty much from its inception and have never had a bad experience on it. Not one. But if people are agreeing to having any person with a control panel at Ebay to rummage thru their account and information, that's pretty much on them. Knowing you need a credit card or bank account to sell, that's a whole lot of blind trust to sell a 20 dollar sports card.

as long as those communications don't involve advice from legal counsel. In fact, they are gold nuggets of evidence in cases of all types. Trust me on this, I've been a paralegal for about 12 years now and have been to trial a number of times. E-mails are admitted as evidence over and over in legal proceedings.
This is over a baseball card. Chances are the person doesn't have the time or money to hire a good enough lawyer. I never said social media wasn't admissible at all, just in this very case. Ebay wins considering they have the money. Its open and shut.

Now your attorney could fight it with a motion to quash or they could object, but it's going to be very difficult to keep that information out of the case. Privacy on the internet is very difficult to establish unless you are talking about medical records or communications with your attorney. Even then, subpoena power is far reaching and almost a certainty in most situations. That said, everyone should be very careful about what they put in e-mail and pms. All of that stuff is on back up tapes and other types of network storage devices long after you've deleted it. Trust me, one of my main functions as a paralegal is gathering, filtering, and organizing evidence, at least 50% of it is found in e-mails. Not trying to be a know it all here, just letting you know that your view on privacy is way off base. In short, counter to what you may think, you pretty much have no privacy on the internet.
You do. You just have to know how to find it. Chances are both persons in this are too young to understand specifically that two wrongs don't make a right, who knows. But harassing somebody, which is what it is, by posting somebodys ebay nic on a public forum over a baseball card auction isn't the way to do things, obviously. I have no horse in this race, but both are at fault.

Ebay can read them word for word. Those communications are not private when sent through Ebay. I have called Ebay to report a buyer and the rep has been looking at the back and forth and told me in this one the buyer said and read it word for word.
