Default Ebay seller to avoid : gemstatestax

I bought a card from this guy with standard envelope. It arrived damaged. Enveloped ripped open and top loader and card chewed up by mail sorter. Clear damage to the card. I contacted him and sent pictures. He basically told me to pound sand. I opened a case with ebay and now he's sending me more messages about how I'm being petty because the card cost $3 and he's not going to do anything. I even sent him all the instructions so he could file a claim as the seller to refund out of the insurance that ebay provides for this type of thing and he refuses to do it. He has a couple of other negative feedback for this same thing so not the first time.

Just wanted to add ebay ID now that I've gone back and forth with this guy a few times and it's clear he's refusing to do what he is supposed to and there are more eyeballs here

Did the seller run it through the mail sorter himself?

Did the seller give you the option to ship it in a padded envelope at an increased cost?

IMO it is a risk you take when having cards shipped with the standard envelope. I would have just refunded your money and moved on but obviously he doesn't want to do that.

Regardless, it's the seller's responsibility to get you the card in the shape that was described.

eBay offers PIP insurance on ESE shipments, so there's no reason to hassle a buyer prior to refunding, especially if the buyer provides pictures of the mangled card.

That's even more ESE proof than a buyer saying the card never arrived.

No and No. And that's why ebay insures them up to $20. Standard envelope option would never work on ebay without the insurance for these instances.

Apparently. Lucky for me this is the first damaged card I've gotten out of several hundred I've bought with standard envelope shipping. I've gotten a couple of others where the envelope got ripped open but the card survived. So I've never had to contact a seller about a damaged shipment but next time I'll just wait and open a case

As a seller, I'd appreciate what you did with the heads up first, then open a case.

Obviously, if you opened the case with no communication first I'd honor the refund and claim PIP, but from a communication perspective, I'd just appreciate the heads up first.

Seller should have been nicer, but this is the reason I don't sell cards under $5 on Ebay. Too much drama over $3.......

I've bought hundreds and sold hundreds of dollar cards on ebay with standard envelope. I've had to open two claims. One for this and one that never arrived. As a seller I think I've had 3 claims opened for cards not arriving after about a week. Other then that I've never contacted a seller or been contacted by a buyer. 99% perfect experiences. But I can understand if you are selling a huge volume then that small percentage adds up to too many hassles. I don't mind eating the loss for $3 but since I know that ebay will cover the refund so the seller isn't effected then I figure I might as well get the money back to spend on the next card.
