there's something hilarious about the idea of "defaming" a small piece of cardboard with cutout pieces of fabric

"Plus, the plaintiffs claim they suffered a loss of reputation, shame, mortification, and injury to their respective feelings, and loss of the value of the LeBron Patch Card. They are seeking damages of at least $6 million."

Oh boy, this could be a fun one.

Will we also see eBay brought into the case (subpoena the 2005 auction details) for the buyer/seller records and confirmation of the "before" photo?

Do these clowns not realize there’s photos of the 44/99 before the patch was swapped?

I’d love to see a counter claim on this.

Paul Lesko has provided some updates on this case and it appears the plaintiff's are still unable to identify CP, although there appears to have been some communication between the two parties. Plaintiff's allegedly knows CP's attorney, so this seems like a odd extra step but the plaintiffs received the judges permission to subpoena Instagram for information on the CP account.

Like I previously posted, hope we see eBay also called into this case. With the debate mostly focused on that 2005 white jersey image, hearing from the seller/buyer of that eBay listing might clear up the discussion about the image/patch being altered.

Thought this was an interesting note from the newest document filing.

In one of the prior updates from March of last year, there was a copy of an email from Ken Goldin that mentioned Upper Deck and Chris Carlin (UD) said their letter of support was incorrect and shouldn't be relied upon.

As usual, Paul Lesko does a great recap, if you wanted to read everything (discovery dispute) but relating to Upper Deck's opinion, this note from UD's attorney suggests either Ken was incorrect or UD has flipped yet again. Maybe the cardporn connection is swaying opinions?

Would be nice if someone could track down one of the original owners and maybe settle the swap/shop(photo) debate.

Chris Carlin is known for not having his facts straight. In 2008 Tiger Woods Exquisite RPAs /10 weren't packed out. The /3 and 1/1 versions were only. The story was that the /10s got damaged so they never made it into the product, but one was sold at a show.

Here is Chris in 2009 not knowing about it, lying about it, or being confused in a spot where no confusion should take place.

I wouldn't put much stock into his knowledge of whether a random LBJ Exqusite Patch is fake or not, if he didn't know the Tiger /10s weren't in 08 Exquisite Football.

I agree with this. He is not always right with the facts for his own company.

Only one exquisite Tiger/10 was released into the product and pulled - it was the one with the inscription on it.

I know this for a fact because I’ve owned them all.

It’s really about if Goldin had firm enough proof to pull the card from auction and destroy its value as a result.
