As mentioned above, there is no issue. PSA would need to recognize the variation and add it to the catalog before any issues could arise. There is no "label error" (PSA also calls these "mechanical errors") because there is only one label.

In other words, as far as PSA is concerned there is currently only one variation of the 2002 Topps Mark Loretta #446 (regardless of who is pictured).
