The money is between the credit card company and the auction house. And in all likelihood, the credit card company takes the loss. I don't see how the owner of the card has not been paid, the liability ends when the card is sold. Just like selling an automobile to the car dealer. All the dents, or previous accidents on the car is the dealer's liability unless there is something that isn't reported properly.
