Never seen a buyer get banned for that. If they try it multiple times then yes its possible. Ebay could just decide the seller protection kicks in. Just like with a fraudulent use chargeback Sellers rarely lose those but Ebay and Paypal almost always do. If the seller covers their bases then the Seller Protection eats it. If a buyer has a history of this they usually still do not ban, but they do remove them from the protection program seen many scammers on the Ebay boards and Facebook complaining they are no longer allowed to open claims on Ebay.
That said there are cases where the buyer does not actually get it despite the tracking showing delivered. Porch pirates, mis-delivery or whatever. So he may not have realy gotten the item. Nobody would really know. If he truly did not get it, it is a valid case and you need to be thankful he did open a claim through Ebay first and not go straight to his CC, especially if you are in MP.
